Welcome to Stanish & Minter Oyster Co. (“we,” “us,” “our”). These Terms & Conditions (“Terms”) govern your use of our website and any purchase of products (collectively, the “Services”). By using this site or placing an order you agree to these Terms.
1. Ordering & Acceptance
All orders are subject to acceptance by Stanish & Minter Oyster Co. We reserve the right to refuse or cancel any order for any reason, including product availability, errors in pricing or description, or suspected fraud. A contract between you and Stanish & Minter Oyster Co. will only be formed when we send an order confirmation email.
2. Pricing & Payment
Prices listed on the site are in U.S. dollars and exclude applicable taxes and shipping charges unless otherwise noted. Payment is due at the time of order. We accept the payment methods displayed at checkout. We may use third-party payment processors — their terms also apply.
3. Shipping & Delivery
We ship live oysters via UPS 2-Day service on specified ship days (Mondays and Wednesdays). Orders placed by the site cutoffs will ship according to the schedule displayed at checkout and in our Shipping & Delivery section. We ship to street addresses only (no P.O. boxes) within the continental United States to ensure safe, timely delivery.
The Federal Mail/Internet/Telephone Order Merchandise Rule requires merchants to ship within the timeframe promised or, if no timeframe was stated, within 30 days, or to notify the customer and offer cancellation/refund options — we follow these obligations in our order and delay notifications.
4. Perishable Goods / Live Shellfish
Our products are perishable and are sold live. By purchasing live oysters you acknowledge receiving and accepting the inherent risks associated with live shellfish. We package oysters in insulated, temperature-controlled boxes and follow strict time/temperature controls. We comply with FDA guidance and applicable shellfish safety programs to minimize hazards and ensure safe handling and shipping of molluscan shellfish.
Because oysters are live perishable goods, we cannot guarantee their condition if an order is left unattended after delivery, delivered to a P.O. box, or otherwise handled contrary to our shipping instructions.
5. Returns, Refunds & Cancellations
Because we ship live perishable items, returns are not accepted. If you receive an order that is damaged, incomplete, or not as described, please contact us within 24 hours of delivery with photos and your order number. We will evaluate the claim and, when appropriate, offer a replacement, credit, or refund.
We comply with applicable consumer protection rules regarding delays, cancellations, and refunds; when we are unable to ship within our promised timeframe we will notify you and provide the option to accept a revised shipment date or receive a prompt refund.
6. Allergens & Food Safety
Shellfish are a known allergen. Do not consume oysters if you have a shellfish allergy. Follow all safe handling and cooking guidelines. We recommend consumers follow FDA guidance on seafood handling and preparation for safe consumption.
7. Warranty & Limitation of Liability
Our oysters are sold “as is” except as expressly provided in these Terms. To the maximum extent permitted by law, Stanish & Minter Oyster Co. disclaims all other warranties, express or implied, including merchantability and fitness for a particular purpose.
In no event will Stanish & Minter Oyster Co., its owners, employees or agents be liable for any indirect, incidental, special, punitive, or consequential damages arising out of your purchase or use of our products, except where such limitations are prohibited by law. Our aggregate liability for any claim related to a product shall not exceed the purchase price paid for the product.
8. Intellectual Property
All content on the website, including text, images, logos, and design, is our property or used with permission. You may not copy, reproduce, or create derivative works from our content without our written consent.
9. Privacy
Your use of the site is also governed by our Privacy Policy, which explains how we collect and use personal information. By using the site you consent to that policy.
10. Governing Law & Dispute Resolution
These Terms are governed by the laws of the State of Oregon, without regard to its conflict of law rules. Any dispute arising under or relating to these Terms shall be resolved in the state or federal courts located in Coos County, Oregon, and you consent to personal jurisdiction and venue there.
11. Changes to Terms
We may revise these Terms at any time. If we make material changes, we will post the updated Terms with a new “Effective date” and, when appropriate, notify users by email or site notice. Continued use after notice constitutes acceptance of the updated Terms.
